Agreement
These terms govern your use of SwagByte (the website, designer, and order services). By creating an account, placing an order, or even browsing the catalog, you agree to these terms. If you don't, don't use the service.
Accounts
You can use SwagByte as a guest for browsing, design, and checkout. Creating an account preserves your designs + order history across sessions and unlocks corporate features (Net-30, quotes, team access). You're responsible for keeping your credentials confidential.
Orders + payment
Orders are accepted when we successfully charge your payment method (card, ACH) or record a valid PO from an approved Net-30 corporate account. Prices include the product blank + decoration; sales tax + shipping are calculated at submit.
Once we begin production, the order is binding — see our returns policy for what can be canceled.
Your designs + IP
You retain all intellectual property rights to artwork you upload. By uploading, you grant SwagByte a license to reproduce that artwork solely for the purpose of producing your order, generating mockups, and storing it for reorders.
You're responsible for confirming you have rights to use any uploaded artwork. Don't upload anything you don't own or have explicit permission to reproduce. We'll honor takedown requests from rights holders and may decline orders containing infringing content.
Guarantee + returns
Misprints, defects, wrong product, and shipping damage are covered by our guarantee. Custom decorated items can't be returned for buyer's remorse — see /returns.
Acceptable use
You agree not to:
- Use SwagByte to produce hateful, illegal, infringing, or sexually explicit content.
- Reverse engineer, scrape, or attempt to extract proprietary data.
- Resell SwagByte's services as a hidden white-label without written agreement.
- Interfere with the platform, attempt to bypass rate limits, or abuse the API.
Termination
We may suspend or close accounts for violations of these terms, fraudulent activity, or 60+ days past due on Net-30 invoices. You can close your own account at any time via account settings; in-flight orders complete per the agreed terms.
Liability + warranty
To the extent permitted by law, SwagByte's aggregate liability for any order is limited to the amount you paid for that order. We don't warrant that the service will be uninterrupted or error-free; we make best-effort commitments to uptime and timely production but don't indemnify lost revenue from delays outside our control.
Changes
We may update these terms. Material changes get an email notice 30 days before effective. Your continued use of the service after the effective date counts as acceptance.
